Enforcement of Patents

Patents hold a significant position in the history of upholding and strengthening the rights of a person who is responsible for an invention. Enforcement of patents has been done to protect this position. Patent rights can be enforced with the help of civil proceedings in the court of law of the respective countries. There is an exception made in some countries, which have made patent issues an act of criminal offense. This can lead the accused to be charged with illegal act and be punished accordingly. An easier way to deal with enforcement of patents in almost all the countries is to settle the matter out of court. In this way the owner of the patents can resolve the issue without suing the defendant. The patent owner asks the defendant to pay a certain amount of loyalty in return of letting the defendant use the patented product. The owner of the patent has to use his patent right very wisely. The ownership of the patent does not give him the right to misuse the powers of owning a patent in any way.

Compensation in the form of monitory repayment is the method by which the infringement in patents is dealt with. The entire procedure of Enforcement of Patents starts with beginning court litigation against the party who has infringed the rights. Enforcement of patents is done on the basis of certain governing rights on patents, which determine the extent and the nature of the enforcement procedure.

There can be a little hindrance to enforcement of patents if the defendant argues about the validity of the patent or the applicability of the patent. This is done when the patent owner decided not to sue the defendant or the infringer of patents.

To avoid the situation to go in favor of the infringer or the defendant countries like United Kingdom have implemented laws. In UK the Certificate of contested validity prevents the defendant to fight his case on the basis of validity of patent.

Patent enforcement basically refers to protecting one’s patent rights and preventing it from being misused or illegally used by others. The most important part of enforcing patent rights is, knowing about the patented product properly before trying to enforce patent laws on an infringer.
