About EU Community Patent
The Community Patent or the COMPAT as it is sometimes referred to is aimed to provide a single patent technicality that would be applicable throughout Europe. This idea of a single uniform patent law is in accordance with the guidelines laid down by the Internal Market. According to the principles of the latter a consistent trade carryout strategy should be present in each individual market place throughout the European continent. At times it so happens that the laws of trade change as soon as you shift to another country within the same continent. This poses as a major problems to expanding companies who have to spend a lot of time in actually understanding the intricacies of the patent laws. This further affects the availability of products and consumer items. Community Patent does away with the problems that is faced by new venturers in European countries. Also the unequal price of products and dealing can be stopped somewhat.
The history of Community Patent
The idea of a single patent law throughout European Union was first conceived in the 1960's. Till date The European Patent Office (EPO) and the European Patent Convention (EPC) are the two ruling bodies that give grants to prospective companies and organizations to patent their products. The European Patent requires for a patent grant to be written in the language of the country where it is going to be applied. This is a costly procedure as one single translation costs approximately 1400 Euro. So the obvious solution to saving the cost and also the time that is wasted in catering to these complicated procedure was to have a single patent law. This lead to the conceptualization of a law that is known as the Community Patent. But this had yet to be be approved by the concerned authorities.
EU Regulation
The beginning of the Millennium saw the Community Patent plea being presented with renewed vigor. The Community Patent Regulation (CPR) was created which stated that the patent application can be filled in either English, French or German and it will be applicable only when it is presented with a translation of the same in its own national language. In fact this EC patent law made a lot of progress in the year 2003 but in the next year the competitiveness council could not arrive at a mutual conclusion which lead to the complication of matters and the enforcement of this uniform law remained an elusive dream.
Community Patent is a single law that the commissions and communities have been trying to get approved. As this law affords a chance to save time and money simultaneously and setting up a business in one of the European countries would not be problematic.
